On Thursday, November 25, the Bombay High Court, in regards to the 2013 Shakti Mills gang-rape case, set aside the death penalty sentence of the three accused, highlighted reports.
Instead, they send them to life imprisonment. The three men were convicted of gang-raping a 23-year-old photojournalist in Mumbai’s Shakti Mills area.
Earlier, they were awarded the death penalty by a Sessions Court. Whilst the bench of Justices SS Jadhav and PK Chavan upheld the Sessions Court’s conviction, they reduced the sentence to rigorous imprisonment for life.
Based on accounts, the accused will not be eligible for parole or furlough. The High Court had held that the constitutional court can’t accord punishment on the basis of a public opinion. Adding that whilst they are setting the death sentence aside, it may be perceived that they countered the view held by the majority.
It, however, stated that the constitutional court followed the procedure. The High Court was hearing appeals filed by Mohammed Kasim Bengali, Vijay Jadhav, Mohammed Salim Ansari who with Siraj Rehman Khan and another unnamed juvenile were tried for the gang rape.
In March 2014, Ansari, Bengali, Jadhav were convicted by the Mumbai Sessions Court. Khan was sentenced to life imprisonment; the juvenile was sent to a correctional facility.
The three were earlier accorded a death sentence and they had been convicted in another rape case that was also done in the same location.
